L-1 Intracompany Transfers

Global Mobility Solutions via L-1 Corporate Transfers

The L-1 nonimmigrant visa category allows multinational companies to transfer key personnel from their foreign offices to perform services at a parent, branch, affiliate, or subsidiary office in the United States. Highly valued for its lack of annual registries and prevailing wage mandates, the L-1 visa is an essential vehicle for global business expansion and talent consolidation.

To qualify, the transferring employee must have been employed by the foreign entity in a managerial, executive, or specialized knowledge capacity for at least one continuous year within the three years immediately preceding the petition for entry into the United States.

L-1A Executives and L-1B Specialized Knowledge Tiers

The L-1 visa is segmented into two distinct categories depending on the employee's role:

L-1A Executive or Managerial Capacity

Designed for individuals who manage the organization, or a department, subdivision, function, or component of the organization, or direct the management of the firm. L-1A visa holders are granted an initial stay of up to three years (or one year for a "new office" startup), with extensions available in two-year increments up to a maximum limit of seven years. Crucially, L-1A status provides a direct, streamlined transition to permanent residency via the EB-1C Multinational Manager green card pathway.

L-1B Specialized Knowledge

Designed for individuals possessing special knowledge of the petitioning organization's product, service, research, equipment, techniques, management, or other interests and its application in international markets. L-1B visa holders are granted an initial stay of up to three years (or one year for a "new office" startup), with extensions available up to a maximum limit of five years.

"Establishing a qualifying corporate relationship is the foundation of any L-1 petition. We work with corporate counsel to map complex shareholding structures and corporate ties to ensure complete USCIS alignment."

New Office Setup and Blanket Petitions

U.S. Startups ("New Office"): For foreign businesses seeking to establish a new office in the U.S., the L-1 visa offers a one-year initial term. Petitions must show that physical premises have been secured and that the new office will support an executive or managerial position within one year of approval, backed by detailed corporate business plans and financial projections.

L-1 Blanket Petitions: Large, established multinational companies may request a pre-qualification of the corporate relationship through a Blanket L petition. Once approved, the company can transfer eligible employees without filing individual petitions with USCIS, significantly reducing processing times at U.S. Consulates.

Taína Vale Immigration Law represents businesses of all sizes, from tech startups establishing their first U.S. office in Los Angeles to global firms relocating senior executives. We manage the detailed corporate mapping, business plans, and petition filings from start to finish.
